Terms of Service

Welcome to Aswell. These Terms of Service ("Terms") are a legal agreement between you and Alperen Sirli, an individual developer based in Poland ("we", "us", "the developer"). By downloading or using Aswell ("the app"), you agree to these Terms. If you do not agree, please do not use the app.

1. What Aswell is
Aswell is a self-care app. It analyses photos you provide to describe visible, surface, changeable features of your skin, face, and posture, and it suggests general habits and exercises based on those readings. It also keeps your history and can show a short written summary of what changed between two readings. Posture is analysed on your device; face readings and those written summaries are processed with the help of an AI provider. Details of how your data is handled are in our Privacy Policy.
2. Not medical advice
This is the most important term. Please read it.
Aswell is not a medical device and does not provide medical, dermatological, diagnostic, or treatment advice. Its readings are informational and cosmetic in nature and may be incomplete or inaccurate.
- Nothing in the app is a diagnosis or a substitute for professional care.
- If the app notes that something may be "worth checking," that is a neutral prompt to consult a professional — not a finding, warning, or diagnosis.
- Always seek the advice of a qualified healthcare provider with any questions about a medical condition. Never disregard or delay professional advice because of something you saw in the app.
If you think you may have a medical emergency, contact your doctor or emergency services immediately.
3. Who can use the app
Face readings are only for people aged 16 or older. They involve biometric data, so anyone who tells us during setup that they are under 16 is blocked from them entirely, and we may restrict them further where the law requires.
The rest of Aswell (posture readings, exercises and habits) is open to younger users. If you are under 16, you may only use Aswell with the permission of a parent or guardian, who agrees to these Terms on your behalf.
By using the app, you confirm that the age you give us is true.
4. Your account
Some features require an account. You are responsible for keeping your login secure and for activity under your account. Provide accurate information, and let us know at privacy@aswell.app if you believe your account has been compromised. You can delete your account at any time from within the app.
5. Subscriptions and payments
Aswell is free to start. Some features (for example, repeat face readings beyond your first free reading, and full history) require a paid subscription.
- Subscriptions are sold and billed through the Apple App Store, under its terms. We do not process or store your payment details.
- Auto-renewal: paid subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Manage or cancel your subscription in your App Store account settings — not in the app.
- There are two plans, monthly and annual, with a 14-day free trial. The exact price, billing period and trial terms are shown to you in the app and at the point of purchase before you pay.
- Except where the law or the store's policy requires, payments are non-refundable. Refund requests are handled by Apple under its policies.
6. Your photos and content
You keep all rights to the photos you provide. By using a reading feature, you grant us the limited permission needed to process your photo solely to provide that reading — for posture, on your device; for face, by sending it to our AI provider for a one-time classification, after which it is discarded by us (our AI provider applies its own short retention window before deleting the request — see the Privacy Policy). We do not use your photos to train AI models, and we do not sell or publish them.
You agree to submit only photos of yourself (or of a person who has consented), and not to upload anything unlawful, or anything that infringes someone else's rights.
7. Acceptable use
Please do not:
- reverse-engineer, decompile, or attempt to extract source code or model prompts from the app or our servers;
- probe, overload, or interfere with the service, or try to bypass its rate limits, cost caps, or entitlement checks;
- use the app to build a competing dataset or service, or resell access to it;
- use another person's account or submit another person's photo without consent; or
- use the app for any unlawful purpose.
We may suspend or terminate access that violates these Terms or that threatens the service or other users.
8. The app is provided "as is"
To the fullest extent permitted by law, Aswell is provided "as is" and "as available", without warranties of any kind, express or implied — including accuracy, fitness for a particular purpose, or uninterrupted availability. AI and on-device readings are estimates of what is visible in a photo and can be wrong. You use the readings and suggestions at your own discretion and risk.
9. Limitation of liability
To the fullest extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the app's readings or suggestions, or from any health decision made based on the app. Nothing in these Terms limits liability that cannot be limited by law (including, for consumers in the EU, your mandatory statutory rights). Where liability cannot be excluded, it is limited to the amount you paid us, if any, in the 12 months before the claim.
10. Changes to the app and to these Terms
We may change, suspend, or discontinue features at any time. We may also update these Terms as the app evolves; when we make material changes we will update the effective date and, where appropriate, notify you in the app. Continuing to use the app after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer, you also keep the protections of the mandatory consumer law of your country of residence, and nothing here removes those rights.
